Drug Wholesalers Sue Merck for Generic Singulair Delay

A group of drug wholesalers is suing Merck, saying the company stalled generic competition for its blockbuster allergy drug Singulair. The plaintiffs, including pharmaceutical wholesalers Louisiana Wholesale Drug and Miami-Luken, accuse Merck of deliberately concealing relevant research when it filed for the ’473 patent covering Singulair (montelukast sodium). The information would have led the patent examiner to reject the claims of the patent, according to the plaintiffs.
