Teva Rebuffed in Patent Cases Over Antibiotic, Herpes Drug

Two federal courts have issued rulings against Teva Pharmaceuticals USA in cases involving its proposed generic versions of Alcon’s antibiotic Vigamox and Novartis Pharmaceuticals’ herpes treatment Famvir. Judge Sue Robinson of the U.S. District Court for the District of Delaware ruled Teva failed to prove that a patent covering Vigamox (moxifloxcin HCl), which is used to treat conjunctivitis, is invalid. Separately, U.S. District Court for the District of New Jersey Judge Dennis Cavanaugh refused to grant Teva’s motion to dismiss two Novartis subsidiaries from the case involving the herpes drug Famvir (famciclovir).
