Court Rules Brand-Drug Makers Not Liable for Generics’ Labeling
A federal judge found that state law doesn’t compel Wyeth and Schwarz Pharma to warn patients about potential risks associated with taking generic versions of the heartburn drug Reglan manufactured by other companies. Judge Vicki Miles-LaGrange of the U.S. District Court for the Western District of Oklahoma agreed with Wyeth and Schwarz that “the imposition of liability on brand name manufacturers for injuries caused by competitor generic manufacturers is inconsistent with Oklahoma law,” according to court documents.
