Daiichi Award in Levaquin Case Reduced by Appeals Court
A federal appeals court has partly reversed a decision awarding certain costs to Daiichi Pharmaceutical related to a patent dispute over the antibiotic Levaquin. In Ortho-McNeil Pharmaceutical Inc., et al. v. Mylan Laboratories Inc., et al., the U.S. Court of Appeals for the Federal Circuit agreed with Mylan’s argument that joint discovery costs in a case involving Levaquin (levofloxacin) should have been apportioned between this case and a parallel case in the U.S. District Court for the District of New Jersey involving Teva Pharmaceuticals USA, according to court documents.
