Court Finds for GSK in Lamictal Breach-of-Contract Dispute
A federal judge has tossed a lawsuit brought by Teva Pharmaceutical Industries against GlaxoSmithKline (GSK) over an alleged breach of contract involving the generic supply of the epilepsy drug Lamictal. Judge Dennis Cavanaugh of the U.S. District Court for the District of New Jersey ruled that Teva hadn’t shown that GSK violated a 2005 contract between the two companies by proposing that pharmacies, group purchasing organizations and long-term care facilities buy its Lamictal (lamotrigine) nonchewable tablets and sell them as generic equivalents, according to court documents.
