Lawmakers Offer Differing Views on Exclusivity at GPhA Event
Sen. Orrin Hatch (R-Utah) and Rep. Henry Waxman (D-Calif.) disagreed on the length of exclusivity needed in legislation for follow-on biologics at the Generic Pharmaceutical Association’s (GPhA) Annual Policy Conference. Waxman criticized the 12 years of data exclusivity in a bill that was offered as an amendment to America’s Affordable Health Choices Act of 2009 as being too long. Hatch, who favors the amendment, said a longer period of exclusivity is needed to spur innovation for brand products, which will lead to lower prices.
