Appeals Court Rules Vermont Data-Mining Law Unconstitutional

In a victory for the pharmaceutical industry, a federal appellate court has declared a Vermont law restricting access to physician prescribing data unconstitutional. The U.S. Court of Appeals for the Second Circuit, in reversing and remanding a lower court decision, ruled 2–1 the Vermont statute “is a commercial speech restriction that does not directly advance the substantial state interests asserted by Vermont, and is not narrowly tailored to serve those interests.”
