Pennsylvania Judge Dismisses Endo and Allergan’s Case Against FTC

A federal judge in the U.S. District Court for the Eastern District of Pennsylvania dismissed a lawsuit against the Federal Trade Commission (FTC) filed by Allergan and Endo Pharmaceuticals.
The two drugmakers sought to challenge the FTC’s authority to bring federal court litigation, rather than administrative proceedings, when challenging conduct that happened and was resolved in the past.
The case was brought when the FTC voluntarily dismissed an enforcement action against the two drugmakers and then refiled the same enforcement action against them in California.
