PATENT LITIGATION WITH ROCHE RESOLVED, BIOSITE SAYS

Biosite July 26 said it has resolved all outstanding patent litigation with Roche Diagnostics and several of that firm's affiliates.
Under the terms of a settlement agreement, Biosite and Roche have agreed to file appropriate requests to dismiss their respective complaints pending in federal district courts in Indianapolis and San Diego, Biosite said.
In addition to dismissal of the legal case, the settlement includes a worldwide, royalty-free, nonexclusive cross-license of the patents involved for which Biosite will pay Roche a one-time licensing fee of $8.5 million, Biosite added.
