FDA Cracks Down on Supplement Companies Making Drug-Like Claims

The FDA’s district offices are cracking down on supplement companies making drug-like claims, as evidenced by two new warning letters.

Both letters, which were issued Jan. 15 but not posted online until this week, accuse dietary supplement companies of improperly making therapeutic, curative and preventative claims about their products. Federal regulations restrict such claims to FDA-approved drugs.

The first letter went to dietary supplement distributor Minnesota-based Nutri-Dyn Midwest, contending that the company’s website used drug-like claims to promote nine products on its website. A facility inspection last year allegedly turned up drug-like claims for 11 other products in various forms, including product labeling, brochures and catalogs.

Company officials did not respond to an email seeking comment.
