BioNTech and Pfizer File Complaint Declaring Noninfringement in CureVac Lawsuit

BioNTech and Pfizer have responded to a patent infringement lawsuit by CureVac over technology allegedly used in their COVID-19 vaccine, calling the lawsuit “groundless.”

The two companies are seeking a court ruling that they did not infringe upon the three CureVac patents in the manufacture, use and sales of their vaccine Comirnaty.

CureVac filed a lawsuit against BioNTech earlier this month. The company said it is not seeking an injunction or any other legal action that would impede the production, sale distribution of Comirnaty, but it wants compensation for the use of its patented technology.
