Proposed Colorado Bill Would Cap EpiPen Costs

Lawmakers in Colorado have introduced legislation that would cap out-of-pocket copays at $60 for a two-pack of EpiPen epinephrine autoinjectors.

The bill proposed by Democrats in the state’s House of Representatives, applies to Colorado residents who are not enrolled in Medicaid or Medicare, or who are not enrolled in a prescription drug coverage plan that limits the patient’s costs for EpiPens. The bill would take effect Jan. 1, 2024, if enacted.

The bill would require health insurers to provide coverage for EpiPens for a maximum patient cost of $60 and that pharmacies only collect $60 for the prescription item.

On the website GoodRx, a two-pack of Viatris’ branded EpiPen can cost more than $635, while a generic version costs anywhere from $100 to more than $280.
