FEDERAL JUDGE UPHOLDS JURY VERDICT IN FAVOR OF BLUESKY IN PATENT CASE WITH KCI

A federal judge in San Antonio Aug. 29 upheld a judgment in favor of devicemaker BlueSky Medical Group in a patent infringement suit brought against the firm by Kinetic Concepts (KCI) in 2003, said Randy McClanahan, the Houston-based attorney for BlueSky.

U.S. District Court Judge Royal Ferguson upheld an Aug. 3 jury verdict that KCI's vacuum assisted closure wound technology patents were valid and enforceable but that BlueSky's Versatile 1 product did not infringe on them. Swiss firm Medela was a co-defendant in the case.
