TERUMO ANNOUNCES PAYMENT OF DAMAGES FROM BIOSPHERE MEDICAL

Terumo has announced payment of damages, in the amount of 590,869 euros, by Biosphere Medical, in accordance with the judgment rendered in favor of Terumo Europe Nov. 18, 2004.

In November 2002, Biosphere Medical announced, in an unanticipated manner, its decision to terminate the exclusive distribution agreement signed in January 2002 with Terumo for its products called Embosphere and Embogold, hydrophilic microspheres used for embolization of vessels in some endovascular treatments.

The court ordered Biosphere Medical to pay to Terumo Europe the amount of 553,288 euros, plus legal fees and interest at the legal rate as of Jan. 23, 2003 (the date of assignation for the title of prejudice resulting from abusive rupture of the contract), as well as the amount of 8,000 euros based on article 700 of the New Civil Law Code.
