EU Court Refuses to Rule in GlaxoSmithKline Case

Europe's highest court refused to rule whether GlaxoSmithKline Plc can restrict drug wholesalers from exporting low-priced products in Greece to more expensive markets, leaving Glaxo no choice but to keep supplying the wholesalers. The European Court of Justice in Luxembourg today said it had no jurisdiction because the Greek competition authority can't refer the case to the EU court. The ruling leaves in place an interim antitrust ruling from Greece's competition authority that ordered Glaxo, Europe's biggest drugmaker, to supply the drugs.
